1. About these terms

These Terms and Conditions (“Terms”) govern your use of the Bakgat Plante website (the “Website”) and any purchase you make from us. By placing an order or using this Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website or place an order.

3. Our products

  • We sell live plants, cacti, succulents and related items (“Products”) via the Website.
  • Because our Products are living, natural items, slight variation in size, shape, colour and appearance between the photo shown and the plant delivered is normal and expected, and is not considered a fault.
  • All plants are shipped bare-rooted and are carefully inspected prior to dispatch to ensure they are free of root rot and disease. This ensures your plant arrives in the best possible condition and reduces the risk of introducing pests or disease into your collection.
  • Plant stock changes regularly. We try to keep stock levels and photos accurate, but we cannot guarantee a specific product will remain available between the time you view it and the time you order it.

4. Prices and payment

  • All prices on the Website are displayed in South African Rand (ZAR) and include VAT.
  • We reserve the right to change prices at any time, but changes will not affect orders already confirmed.
  • We currently accept payment via EFT / bank transfer.
  • For EFT payments, your order will only be processed and dispatched once we have received and confirmed your payment in our bank account, using your Order ID as reference.
  • We make every reasonable effort to display accurate pricing. If a pricing error occurs, we reserve the right to cancel the order and refund any payment made in full.

5. Placing an order

  • Adding a product to your cart and completing checkout constitutes an offer to purchase, which we may accept or decline.
  • You will receive an order confirmation by email. This confirms we have received your order, not that the order has been accepted.
  • We reserve the right to refuse or cancel any order, including where: stock is unavailable, there is a suspected pricing or listing error, or we suspect fraudulent activity. Where we cancel an order, we will refund any payment received in full.

6. Delivery and local pick-up

  • We currently offer the following options: Courier delivery nationwide. Available options and costs are shown at checkout.
  • Estimated delivery times are provided in good faith but are not guaranteed, as they depend on courier service providers outside our control.
  • Risk in the Products passes to you once the Products are delivered to the address you provided, or once collected via local pick-up.
  • For local pick-up, please inspect your plant(s) before leaving our premises. Once you have accepted the plant(s) at pick-up, this confirms you are satisfied with their condition.
  • In line with section 46 of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), we will fulfil your order within 30 days of receiving it, unless we have agreed otherwise with you. If we are unable to do this, we will notify you and refund any payment made within 30 days of that notification.

8. Plant care disclaimer

  • We provide general plant care guidance in good faith, but plant health after delivery depends on factors outside our control, including your local climate, watering, light conditions, and handling.
  • Other than as set out in our Returns & Refunds Policy (for example, plants that arrive dead or damaged in transit), we cannot accept responsibility for a plant’s health once it has been safely delivered or collected in good condition.

9. Limitation of liability

  • To the fullest extent permitted by law, Bakgat Plante will not be liable for any indirect, incidental or consequential loss arising from your use of the Website or purchase of our Products.
  • Nothing in these Terms limits any right you have under South African law, including the Consumer Protection Act 68 of 2008, that cannot lawfully be excluded.

10. Intellectual property

All content on this Website, including text, photos, and logos, belongs to Bakgat Plante or its licensors and may not be copied or reused without our written permission.

11. Privacy

We process your personal information in accordance with our Privacy Policy and in compliance with the Protection of Personal Information Act 4 of 2013 (“POPIA”).

12. Governing law

These Terms are governed by the laws of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.

13. Changes to these terms

We may update these Terms from time to time. The version published on the Website at the time of your order will apply to that order.
